Terms of use
These terms are the agreement between you and Nest AI Care Ltd (“we”, “us”) for using the NEST app and this website. By creating an account or using NEST, you agree to them. If you don’t agree, please don’t use NEST. Our privacy policy explains what we do with your data.
What NEST is
NEST suggests short, simple activities to do with your baby, matched to their age, and walks you through them one at a time. It offers general ideas for play and time together. It isn’t medical, health or developmental advice, and it doesn’t replace your midwife, health visitor, GP or any other professional who knows your baby.
Your baby’s safety comes first
- Stay with your baby for the whole of every activity.
- Stop whenever your baby shows they’ve had enough, or if anything feels wrong. Each activity lists signs to watch for, but no list covers everything, and you know your baby best.
- Skip any activity that doesn’t suit your baby, for example because of a health condition, because they were born early, or because a professional has advised against it.
- If you’re worried about your baby’s health or development, speak to your health visitor or GP, or call NHS 111. In an emergency, call 999.
Who can use NEST
You need to be 18 or over, and a parent or carer of the baby you use NEST with. You can use NEST for yourself and your family, not for a business.
Your account
- Keep your password to yourself. Tell us straight away if you think someone else has used your account.
- You can delete your account at any time in the app’s settings, with Delete my account and data.
- We may suspend or close an account that is used to break these terms or the law, or to harm NEST or other people. We’ll tell you why, unless the law stops us.
Using NEST fairly
Please don’t:
- copy, sell or share the app’s activities, pictures or text outside your family
- try to break, overload or get around the security of the app or our servers, or reverse engineer the app except where the law allows it
- use someone else’s account, or use NEST for anything unlawful
Our content
The activities, illustrations, text and design in NEST belong to us or to the people who license them to us. You may use them with your own baby and family. We work hard to keep every activity accurate and gentle, but we can’t promise that each one suits every baby, or that NEST will always be available and free of mistakes.
Paying for NEST
If any part of NEST costs money, we’ll show you the price before you pay, and you’ll never be charged without agreeing to it first. Purchases made through the App Store or Google Play are also covered by Apple’s or Google’s terms.
Changes to NEST and to these terms
We may change, add or remove features. If we change these terms in a way that matters to you, we’ll tell you before the change takes effect. If you don’t agree to the new terms, you can delete your account.
Our responsibility to you
- If we break these terms or fail to use reasonable care and skill, we’re responsible for loss or damage you suffer that is a foreseeable result. We aren’t responsible for loss or damage that isn’t foreseeable.
- NEST is for private use, so we aren’t responsible for any business loss.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit, and nothing affects your legal rights as a consumer.
Ending this agreement
You can stop using NEST at any time by deleting your account. We may stop offering NEST, and if we do we’ll give you reasonable notice first.
If you downloaded NEST from the App Store
- These terms are between you and us, not Apple. We, not Apple, are responsible for NEST and its content, for supporting it, and for dealing with any claim about it, including a claim that it breaks the law or infringes someone’s rights.
- Apple has no obligation to support or maintain NEST. If NEST doesn’t meet a warranty that applies to it, you can tell Apple, and Apple may refund what you paid for it, if anything. Apple has no other warranty obligation for NEST.
- Your licence to use NEST is a personal one, on Apple devices you own or control, as Apple’s Usage Rules allow.
- You confirm you aren’t in a country under a US government embargo, or on a US government list of restricted parties.
- Apple and its subsidiaries can enforce these terms against you as a third party beneficiary.
The law that applies
These terms are governed by the law of England and Wales, and any dispute about them can be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring it in the courts where you live.
